SAN JOSE, CA – In light of recent immigration enforcement actions in Los Angeles County and the anticipated increase in such activity here in Santa Clara County, we write to reaffirm our unwavering support for our immigrant students and families.
As the California county with the largest concentration of immigrant community members, we understand the fear and uncertainty that these developments may cause. We want to be clear: Santa Clara County schools remain safe, inclusive spaces for all students, regardless of citizenship or immigration status.
The United States is a nation of immigrants, shaped and strengthened by generations of individuals who came seeking opportunity and freedom. Immigrant families, including those seeking asylum, are an integral part of our communities. Our schools play a critical role in welcoming these families and helping every student feel seen, supported, and empowered to succeed.
We remain firmly committed to protecting immigrant students and families. This commitment is both moral and legal. The U.S. Supreme Court has long upheld that all children, regardless of immigration status, have the right to attend public elementary and secondary schools (Plyler v. Doe, 457 U.S. 202 (1982)). As educational leaders, we will continue to uphold that right in full.
To support our immigrant community during this time, we want to be transparent about the policies and practices agreed to by the districts in Santa Clara County, which are in alignment with state and federal laws and regulations:
- If an immigration-enforcement officer arrives at a school site, they will not be permitted on campus without a valid, signed judicial warrant or evidence of exigent circumstances.
- If immigration-enforcement officers request information about a student, our staff will consult legal counsel and take all lawful steps to avoid disclosure. Parents or guardians will be notified before any information is shared.
- Our schools will not collect or maintain immigration status information about students or families, except when legally required to administer specific state or federal programs. We will not voluntarily collaborate with immigration-enforcement officers.
