SAN JOSE, CA – In September 2025, the Santa Clara County Superintendent of Schools requested that the Fiscal Crisis and Management Assistance Team (FCMAT) conduct an Assembly Bill (AB) 139 extraordinary audit of Alum Rock Union School District. The request was made to determine whether fraud, misappropriation of funds, or other illegal fiscal practices may have occurred within the district.
The extraordinary audit focused specifically on District reimbursements to Board members and certain transactions occurring between July 1, 2022, and June 30, 2025, encompassing fiscal years 2022–23, 2023–24, and 2024–25. The request followed concerns raised from parents, community members, and district employees regarding potential questionable board member reimbursements, specifically where district funds may have been used to reimburse board members for college-level coursework or other similar training.
FCMAT has completed a comprehensive review of all reimbursements to all board members to determine whether district funds were used in a manner that was both generally appropriate and a typically allowable educational use of district funds, as well as whether each reimbursement followed established district reimbursement policies for reimbursements that occurred between July 1, 2022 and June 30, 2025 and has issued a
report. According to the report's conclusion, “insufficient evidence exists to indicate that fraud, misappropriation of funds and/or assets, or other illegal fiscal practices may have occurred.”
Dr. David M. Toston, Sr., Santa Clara County Superintendent of Schools, will formally present the results of the audit to the Alum Rock Union School District governing board at their regularly scheduled board meeting on March 26.
