This is an agreement between the Santa Clara County Board of Education
(Board) and the participating districts of Gavilan Community College District,
Aromas-San Juan Unified School District, Gilroy Unified School District, Morgan
Hill Unified School District, San Benito County Office of Education, and San
Benito High School District. The agreement concerns the development, operation
and maintenance of SCROP and specified agreed rights and responsibilities of
Board and the SCROP Operational Committee. For purposes of this agreement the
above mentioned five school districts and the Offices of Education of San Benito
and Santa Clara Counties will be hereafter identified as member Local Education
Agencies (LEAs).
TERM OF AGREEMENT
This agreement shall become effective upon the signing of the agreement by
the parties and shall continue until terminated by law or withdrawal of a
party in accordance with the terms as herein specified.
Any party may withdraw by giving notice to the other parties of its intent
to withdraw. The notice of intent to withdraw shall be given to all parties
hereto no later than October 1 of the fiscal year, and notice of final
decision to withdraw is given to all parties no later than January 1 of that
fiscal year. Such withdrawal shall be effective upon the conclusion of the
fiscal year within which the notice of intent to withdraw is given.
GENERAL AGREEMENTS
1. Member LEAs, jointly, hereby give assurance of their intention to
provide vocational courses of instruction for all eligible students residing
within the participating districts through SCROP.
2. Member LEAs pledge support for the SCROP through vocational counseling
for pupils; cooperation in planning curricula, schedules, and joint use of
existing facilities and equipment.
3. Member LEAs jointly agree to establish and maintain an Operational
Committee to be chaired by the Superintendent/designee from the Santa Clara
County Office of Education subject to annual confirmation by the Operational
Committee. The membership of the Operational Committee shall include:
a. The Superintendent or his designee from each member LEA.
b. One Board member or citizen selected by the Governing Board of each
member LEA.
4. It is the specific intent that the Operational Committee shall have
policy-setting and decision-making authority for the SCROP to the extent
possible under State law and the policies and procedures of Board.
5. The Superintendent/designee of the Santa Clara County Office of
Education shall maintain authority for the administrative unit including:
a. Budget development for the central office and budget monitoring for
program operations.
b. Personnel and staffing levels within budget approved by the Operations
Committee.
c. Implementation of SCROP long range plans.
RESPONSIBILITIES OF THE SCROP OPERATIONAL COMMITTEE
1. At least annually, the SCROP Operational Committee may determine and
make recommendations to Board regarding:
a. The budget.
b. Staffing patterns.
c. Calendars.
d. Instructional programs.
e. Support services required for the education of pupils enrolled in
SCROP.
f. Provide certification to the State Department of Education that
program content and instruction in classes are congruent with filed plans
and State regulations and applicable laws.
2. The Operational Committee shall be responsible for the ongoing operation
and planning of the SCROP. This operation shall be accomplished through the
services of the SCROP Director and staff, the services of the Santa Clara
County Office of Education, and in cooperation with staff of member LEAs. The
responsibility may include:
a. Vocational counseling and enrollment of pupils.
b. Development and operation of pupil admission requirements which
reflect the prerequisites.
c. Placement of graduates in appropriate employment or advanced training
programs.
Evaluation of instructional and support services.
e. Development of new instructional programs and selection of program
sites.
f. Approval and purchase of equipment and supplies for instructional and
support services following fiscal procedures established by the Santa Clara
County Office of Education.
g. Development of contracts for instructional services and purchase or
lease of sites and equipment following fiscal procedures established by the
Santa Clara County Office of Education.
h. Transfer of funds within the approved annual budget for SCROP
following fiscal procedures established by the Santa Clara County Office of
Education.
BOARD RESPONSIBILITIES
1. Board shall:
a. Approve the annual budget.
b. Approve all SCROP classified and certificated positions that are to be
employees of Santa Clara County Office of Education.
c. Approve the annual plans for instructional and support programs.
d. Certify to the State Department of Education that attendance
accounting and expenditures are legally correct.
SEVERABILITY
Should any portion, term, condition, or provision of this agreement be
decided by a court of competent jurisdiction to be illegal or in conflict with
any law of the State of California, the validity of the remaining portions,
terms, conditions, and provisions shall not be affected thereby.
This agreement is hereby accepted on the date set forth in the execution of
signatures hereto
